Ukraine: Draft law on Chemical Safety

Ukraine has published draft law on Chemical Safety. The aim of the draft Law is to create a regulatory framework for chemical management and to clearly define powers and responsibilities of businesses and government agencies.

The draft Law would implement GHS classification and labelling into the national legal system.

The law would impose mandatory registration of all chemical substances. Any chemical substance that is manufactured, imported or placed on the Ukrainian market would have to be registered.  Downstream users would not have to register chemical substances provided that these substances have already been registered by their suppliers, considering the total yearly quantity of each substance that has been placed on the Ukrainian market.

The draft Law would also implement the provisions of the following international conventions:

  • Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal
  • Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade
  • Stockholm Convention on persistent organic pollutions (POPs)

The final date for comments is set for 8 February 2021.
