What is a declaration of conformity for a cosmetic or perfumery product?
A document which confirms that the product complies with the requirements of the Technical Regulation on the Safety of Perfumery and Cosmetic Products (ТR СU 009/2011) (TR on Cosmetics and Perfumery).
Which cosmetic and perfumery products require a declaration of conformity?
A declaration of conformity is required for products to which the Technical Regulation on the Safety of Perfumery and Cosmetic Products (ТR СU 009/2011) applies, except products listed in Annex 12 to this Technical Regulation. Products listed in Annex 12 must undergo state registration procedure. These products include self-tanning products, skin lightening products, hair perms, depilation products, etc.
Who obtains a declaration of conformity for a cosmetic or perfumery product in Russia?
The manufacturer or a person authorised by the manufacturer or the importer ("the Applicant"), provided that this person or organisation is duly registered in Russia (or in another Customs Union member state).
Documents required in order to adopt and register a declaration of conformity for a cosmetic/perfumery product
The Applicant is required to develop and/or collect the following documents:
- List of ingredients, specifying the concentrations of restricted substances (the lists of these substances are contained in Annexes 2-5 to the Technical Regulation (TR) on the Safety of Cosmetics and Perfumery);
- Copies of documents which assess and confirm physical, chemical and organoleptic properties of the product;
- Testing protocols which confirm that the products comply with safety requirements contained in clauses 3-6 of Article 5 of the TR on Cosmetics and Perfumery (these clauses impose pH parameters, microbiological parameters, concentration limits for toxic chemicals, such as arsenic, mercury and lead and some other parameters, which are provided in details in the TR itself.
- Label samples complying with requirements of clause 9 Article 5 of the TR on Cosmetics and Perfumery;
- Manufacturer’s document which notifies that the manufacturer has complied with the general GMP principles OR with the TR requirements OR a quality management certificate confirming that the manufacturing process conforms with the GMP principles; and
- Documents which evidence the claimed consumer properties of the products and which are stated on the consumer packaging of the product (e.g. antiseptic properties, SPF-factor, anti-inflammatory, anti-wrinkle, etc.).
All documents in foreign language must be translated into Russian and certified by a notary or by a translator, provided that the translator attaches a copy of his/her diploma confirming his/her qualification as a translator.
The manufacturer or supplier must submit the declaration to one of the accredited certification bodies of the relevant Customs Union member state. The accredited certification body will register the declaration in the special registry.
