EAEU: Proposed “chocolate” amendments to the food safety technical regulation

Chocolate manufacturers and importers may soon have to comply with additional requirements applicable specifically to certain types of chocolate and chocolate products.

Amendments to the Technical Regulation on Food Safety (TR TS 021/2011) have been proposed. If adopted, these amendments would apply to chocolate, chocolate glaze, chocolate mass put into circulation in the territory of the EAEC, including cocoa products, which are put into circulation as an integral part of food products. The amendments would set additional requirements for:

  • bitter (black), dark, ordinary, sweet, milky, extra-dairy and white chocolate, chocolate in powder, chocolate with filling;
  • ordinary, milk and white chocolate glaze;
  • bitter (black), dark, ordinary, sweet, lactic, extra-dairy and white chocolate mass;
  • cocoa products: cocoa liquor, cocoa butter, cocoa powder, cocoa butter cake, cocoa powder.

The amendments would also regulate the identification of chocolate, chocolate glaze, chocolate mass and cocoa products and set requirements for the use of fat and oil products and animal fats, as well as certain types of flavors in the production of chocolate, chocolate glaze, chocolate mass and cocoa products.

For example, the amendments would prohibit the use of animal fat (except milk fat) in the production of chocolate, chocolate glaze and chocolate mass.

The amendments would also revise the list of standards for the Technical Regulation on Food Safety.
