Moldova: adopted law on industrial emissions
As of 21 October 2024, the law on industrial emissions enters into force in Moldova.
The law takes into consideration the provisions of the EU Directive 2010/75/EU on industrial emissions as well as Directive (EU) 2015/2193 on the limitation of emissions of certain pollutants into the air from medium combustion plants.
According to the adopted law, facilities performing certain types of industrial activity listed in Annex 1 to the adopted Law have to obtain a comprehensive environmental permit and facilities performing activities listed in Annex 2 to the adopted law – an environmental permit issued by the Environmental Agency of Moldova.
The activities listed in Annex 1 to the adopted law are very similar to those listed in Annex 1 to of the EU Directive 2010/75/EU on industrial emissions.
The activities listed in Annex 2 to the adopted law include:
- combustion of fuels in installations with a total rated thermal input from 5 MW to 50 MW;
- electrical energy transmission and distribution;
- manufacture of electronic components (excluding assembly operations);
- manufacture of communication equipment (excluding assembly operations);
- manufacture of electrical and electronic equipment (excluding assembly operations); etc.
The law further regulates the use of best available technologies (BAT) and emission limits.
Special provisions of the law regulate incineration installations, installations that use organic solvents and installations producing titanium dioxide.
