
As of 3 November 2025, Order No. 280 introducing amendments and additions to the earlier Order No. 332 dated November 27, 2023 on the allocation of funds by the Extended Producer Responsibility (EPR) Operator, entered into force.
The updated regulation refines the procedures governing how funds collected from producers and importers under the Extended Producer Responsibility (EPR) mechanism are distributed by the designated operator. The order was officially registered with the Ministry of Justice on October 24, 2025, under registration number 37219.
The amendments aim to improve transparency, accountability, and coordination in the management of funds directed toward waste collection, transportation, sorting, processing, recycling, and disposal of products after the end of their lifecycle.
Key updates include:
- Introduction of new definitions and systems:
The amended rules now define “basic criteria” for applicants eligible to receive payments. These criteria ensure that only entities legally operating in Kazakhstan, not undergoing bankruptcy or liquidation procedures, can access EPR funds. - Two-tier information system:
The system for processing and approving payments has been restructured into two integrated levels:
- The first level, or registrar information system, will oversee the monitoring of government support measures and maintain an electronic registry of applications.
- The second level consists of sectoral information systems operated by the EPR Operator, responsible for receiving and verifying applications from waste management entities.
- Enhanced digital control:
New mechanisms, including format-logical control and post-format-logical control, have been established to ensure data accuracy and compliance of applicants with eligibility criteria through integration with government databases.
- Clarification of roles and responsibilities:
A new entity, the Registrar—a state-owned company designated by the central budget authority—will provide technical support for the monitoring system and ensure correct data management.
- Updated forms and procedures:
Applications, contracts, and statements related to the receipt of payments have been standardized in revised annexes to the rules. Applicants are now required to give explicit consent for the collection and processing of personal data by both the Operator and the Registrar.
Control over the implementation of the new rules is assigned to the Vice Minister overseeing the waste management sector.
This update reflects Kazakhstan’s ongoing effort to modernize its waste management system, improve environmental governance, and ensure the efficient use of funds collected under the Extended Producer Responsibility framework.
