UKRAINE: Draft law on Classification, Packaging and Labelling of Chemical Products

Ukraine is reviewing a proposed draft Technical Regulation (TR) on the Classification, Packaging and Labelling of Chemical Products (the "Ukrainian CLP Regulation"). 

The aim of the draft TR is to align the Ukrainian requirements with the Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures (the CLP Regulation). 

If adopted, the law (Technical Regulation) would apply to all chemical products placed on the market in the territory of Ukraine.

Manufacturers, importers, suppliers and other economic operators placing chemicals on the market in Ukraine would have to ensure that these chemical products have been classified in accordance with the criteria set out in the relevant Parts (B-D) of the Annex I to the draft TR. If any chemical products have been classified as hazardous (i.e. have been assigned one or more hazard classes) these economic operators would have to ensure that such chemical products are properly packaged and have appropriate warning labels.

If adopted, the Ukrainian CLP would not apply to:

-Radioactive substances;

-Chemical products placed into bonded warehouses or those in transit;

-Chemical products used exclusively for research and scientific purposes;

-Waste chemical products;

-Medicines;

-Medical products; and

-Food and animal feedstuffs.
