UZBEKISTAN: Product certification process to involve checking breaches of IP rights

As of 17 May 2023, all product certification procedures in Uzbekistan are to include checks for compliance with intellectual property rights.

In accordance with the adopted amendments, product certification in the National Certification System of the Republic of Uzbekistan will include (among other things) verification of compliance with intellectual property rights (trademarks, service marks, appellations of origin, geographical indications, and industrial designs) (IP objects).

The Certification Body is to perform verification of compliance with intellectual property rights following the procedure below:

a) during consideration of an application for product certification, including identification, selection and delivery of samples to the laboratory, examination and verification of compliance with the rights to intellectual property objects is to be carried out by the Certification Body within 2 working days.

b) if the Certification Body detects any identical names or similarities to the degree of confusion with any intellectual property objects protected by the legislation, including names and other details used in product samples (labels and packages) selected for certification tests during the study and verification period, the Certification Body will issue a reasoned refusal to the applicant.
